CPSC eFiling Rule Could Impact Your Zone - NAFTZ Needs Your Feedback

In January the Consumer Product Safety Commission (CPSC) published a final rule requiring electronic submission of required Certificates of Compliance (certificates). If you admit goods subject to CPSC regulations, now is the time to review these new regulations and prepare for data submission on your weekly estimates (CBPF 3461).

For CPSC regulated products and substances entered from an FTZ for consumption or warehousing, the Final Rule is effective on January 8, 2027.  That is 16 months away, and U.S. FTZs that participated in earlier pilots of this data collection say that this is a tight time frame for implementation.  (Note that for entry types other than 06, implementation is July 8, 2026.)

NAFTZ has a CPSC Working Group that submitted comments to the public FRN request for comments on the CPSC regulations and continued dialog with the agency before and after the regulations were published.  This work resulted in the extended time frame for implementation in FTZs, six months later than the effective date for other U.S. importers.

In the response to comments on the rule, CPSC acknowledges that there are system limitations with filing the required data, and that a more ideal situation would be for U.S. FTZs to file this data on the e214 at the time of admission.  However, since this is not currently an option and CBP has not determined when this will be available, CPSC is requiring the trade to develop the capabilities to meet the rule.

NAFTZ has asked the Automation Committee to evaluate the rule and possible options for U.S. FTZ filings.  In the meantime, we are encouraging all members who have goods subject to CPSC regulations in their zones to review the rule and let us know how you plan to meet the requirements.  What percentage of your goods are subject?
